Terms and Conditions

1. Introduction
These Terms & Conditions (“Terms”) govern all services provided by Delta Creative Studio LLC, a Colorado Limited Liability Company (“we,” “us,” or “our”). By using our services, making a payment, or participating in onboarding, the client (“you” or “client”) agrees to be bound by these Terms.

3. Refund & Cancellation Policy
At Delta Creative Studio LLC, we are committed to delivering high-quality services and ensuring client satisfaction. To maintain fairness and transparency, we have outlined our refund and cancellation policy below.
1. Website Development Services
Design Phase Refunds: Clients may request a refund only during the design phase of a website development project. Once the client has approved the design and we have entered the development phase, no refunds will be issued under any circumstances.
Development Phase: By proceeding past the design approval, the client acknowledges and agrees that the project is non-refundable due to the time, resources, and custom work involved.
2. SEO & Marketing Related Services
SEO, advertising, and marketing-related services are non-refundable once the service period has started.
Clients may cancel these services by providing a written notice at least 30 days in advance. The service will continue until the end of the current billing cycle, and no further charges will apply after the 30-day notice period.
No partial refunds will be issued for unused time or paused campaigns during an active billing cycle.
3. Exceptions
We reserve the right to make exceptions in rare cases where we determine a refund is warranted, but this is done entirely at our discretion.
4. Cancellation Policy for Marketing Packages
All marketing packages require a minimum of 30 days’ written notice for cancellation. Notice must be submitted via email to your account manager or our support team.
Cancellations received with less than 30 days’ notice will result in continued billing for the following billing cycle.
5. Client Responsibilities
To ensure project success, you agree to the following:
-Provide all requested materials, content, and feedback within seven business days of each request.
-Maintain consistent communication throughout the project.
-Act in good faith and not intentionally cause unreasonable delays.
If the client:
-Fails to respond or participate actively for 14 consecutive days, or
-Delays the project intentionally or through neglect, the money-back guarantee becomes null and void, and the client will remain responsible for all fees incurred up to that point.
6. Scope Changes & Additional Work
Only the work outlined in the agreed proposal is included in your project.
Changes, revisions beyond the specified rounds, or feature requests not included in the original proposal will be treated as additional work.
Additional work will be billed at $25/hour unless otherwise agreed.
7. Payment Terms
By making payment, you automatically accept these Terms & Conditions.
A deposit is required as outlined in your proposal or invoice.
Payment schedules and milestones will be defined in your agreement.
All payments are non-refundable after the refundable phase ends (see Section 3).
Invoices not paid by the due date will incur a 1.5% monthly late fee (18% annualized) or the maximum permitted by law, whichever is lower.
A 7-day grace period applies before late fees are charged.
If payment remains unpaid for more than 30 days, Delta Creative Studio LLC reserves the right to suspend work until the outstanding balance is settled.
Accounts that remain unpaid after 60 days may be sent to collections or pursued through legal action. The client is responsible for any collection costs and legal fees incurred.
Outstanding balances are due regardless of project delays caused by the client.
Once the website is completed and live, a recurring hosting fee of $99 per month will be automatically invoiced and is due monthly unless otherwise specified.
8. Revisions
Each project includes up to 3 rounds of revisions unless stated otherwise.
Additional revisions will be billed hourly or flat, as agreed.
Revision rounds apply only before the Design Approval Document is signed.
9. Termination
Either party may terminate the project in writing. Upon termination:
Refunds will only be issued according to Section 3.
The client remains responsible for all work completed to date.
Abandoned projects (as defined in Section 3.2) are non-refundable.
10. Ownership and Intellectual Property
Ownership of all final deliverables transfers to the client upon full payment.
Until full payment is received, all project assets remain the intellectual property of Delta Creative Studio LLC.
11. Limitation of Liability
We are not liable for:
Delays caused by client non-responsiveness.
Loss of profits, business interruptions, or indirect damages.
Consequential or incidental damages.
Outcomes resulting from incomplete, inaccurate, or delayed client input.
12. Governing Law
These Terms shall be governed by and construed under the laws of the State of Colorado, without regard to conflict of law principles.
Any disputes shall be resolved through good-faith mediation. If unresolved, disputes may proceed to binding arbitration in Colorado.
